On 06 May 2022, Vietnam Lawyers Association held a seminar on the topic “Vietnam tourism real estate market: some legal issues, practices, and solutions” in Khanh Hoa province. The main purpose of the seminar is to provide troubleshooting solutions for investment projects in Vietnam’s tourism real estate market, which has been invested hundreds of trillions of dongs being “jammed”, especially the solutions to ensure the harmonization of interests among enterprises, investors, and the State in the context that the tourism industry has many opportunities to recover from the impact of the Covid-19 Pandemic.
The seminar was held to contribute to the completion of the project of Land Law (amendment) according to Resolution No. 17/2021/QH15 dated 27 July 2021 of the National Assembly about the “2020 Law, Ordinance building Program”. Lawyer Le Thi Tuyet Dung joined the seminar and spoke as an expert on behalf of DL & PARTNERS.
At the seminar, Lawyer Le Thi Tuyet Dung presented a speech on the topic “LEGAL ISSUES ABOUT THE BUSINESS OF TOURISM REAL ESTATE AND SHORTCOMINGS ARISING IN PRACTICES”. In the speech, Lawyer Dung gave opinions on tourism real estate projects built-in “residential land does not form residential units”, from which gave petition on the activities of issuing Certificates of land use right, ownership of the houses and other assets attached to land (Certificates) for the investor of retreat real estate projects and the buyer of retreat apartments/villas.
In addition, Lawyer Dung also proposed that the Government needs an issuance a Decree reserved for tourism real estate, which will set out specific and specialized provisions for types of tourism real estate.
At the end of the seminar, the Head of the Seminar’s organizing board, Ph.D. Nguyen Van Quyen – President of the Vietnam Lawyers Association appreciated the opinion-contribution from experts, including petitions from Lawyer Le Thi Tuyet Dung.
